    At 40, Mr Tawanda Nyambirai the TN Holdings boss has managed to achieve what most could have considered impossible for someone who is a lawyer by profession. How can a lawyer make a breakthrough in the complex banking sector? His secret is that of treating his customers as kings as he makes it his business to know what customers need and then reaches out to meet those needs.

    He is the major shareholder in TN Holdings through his investment vehicle Nyambirai Associated Trusts. TN Holdings is the holding company for TN Financial Services (Pvt) Ltd, TN Asset Management (Pvt.) Ltd, TN Microfinance and TN Harlequin- a furniture division.

    Tawanda holds a Bachelor of Laws Honours Degree from the University of Zimbabwe and a Certificate in Conflict Resolution from Uppsala University, Sweden.  Early in his career, Tawanda represented himself against compulsory contributions to the National Social Security Agency (NSSA). The Nyambirai vs NSSA case gave the Supreme Court the opportunity to set the test to be applied in determining the scope of derogations from fundamental rights that can be considered to be reasonably justifiable in a democratic society. This case has been referred to beyond the borders of Zimbabwe.

    In 1997, Tawanda successfully handled the case of Econet vs the Minister of Telecommunications that resulted in Econet being duly licensed to operate a mobile telecommunications network within, into and from Zimbabwe. The success in this case changed the telecommunications landscape in the country and put paid to the monopoly of the PTC which, although declared unconstitutional years earlier, remained in existence.

    What was particularly impressive about this case were the means of gathering evidence which Tawanda and his team employed, which involved obtaining an Anton Pillar order to search and seize records of deliberations of the Technical Committee, an event which proved decisive in the matter as it unearthed damning evidence of bias and manipulation of the outcome of the tender process that had resulted in the licensing of Telecel.

    The importance of the victory in this case is evident in the role that Econet has contributed to the development of the economy of Zimbabwe through employment creation, revenue paid to Government, and the revolution in electronic payment systems through the use of Ecocash.

    PROMINENT Harare lawyer and serial entrepreneur Tawanda Nyambirai, the founding director of Steward Bank, formerly TN Bank, has engineered a remarkable return to the financial institution he founded, after raising his shareholding in the bank holding company to a controlling interest.

    His return follows significant restructuring of EcoCash Holdings Zimbabwe Limited (EHZL)'s shareholding, which culminated in Mr Nyambirai assuming control of the bank he founded.

    He is now the group chief executive officer of EHZL.

    Following the sale of TN Bank to Econet Wireless in 2012, Mr Nyambirai's association with the bank continued through his connections to TN Asset Management (TNAM).

    He explained the series of events that led to his return and ultimate acquisition of additional shareholding in the company.

    "I developed TNAM to be the second largest asset manager in Zimbabwe after Old Mutual, by funds under management," he said. "As TNAM, we were the underwriters of the EcoCash Holdings Zimbabwe Limited rights offer last year."

    The underwriting, he explained, resulted in TNAM acquiring an additional 25 percent shareholding in the bank holding company after the transfer of fintech assets, including EcoCash, to Econet.

    He noted that Econet's strategic focus had shifted towards fintech, creating an opening for him.

    "Therefore, there was an opportunity to increase my stake beyond 25 percent," Nyambirai stated. "I was always sentimentally attached to the bank as its founder.

    "I had the capacity to increase my shareholding. So, I took the opportunity."

    He now controls over 53,2 percent of the bank holding company, with the additional 25 percent subject to regulatory approval from the Reserve Bank of Zimbabwe.
